Trisha Krishnan Resolves Property Dispute Amicably Madras High Court Orders Court Fee Refund


Renowned Indian actress Trisha Krishnan has successfully settled a contentious property dispute with her neighbours, resulting in the Madras High Court ordering the refund of the court fee she had paid when filing a civil suit earlier this year. This decision came after the court took note of a joint compromise memo signed by Ms. Krishnan, her neighbours Mr. Meyappan, his wife Ms. Kaveri, and their respective counsel.

The roots of the dispute date back to January 2024, when Ms. Krishnan sought legal intervention to obtain a permanent injunction against her neighbours. She aimed to restrain them from carrying out any further demolition or construction activities on the eastern wall of their property, activities that risked impairing the structural integrity of her own adjacent building on Cenotaph Road Second Lane in Chennai.

The case was first heard on January 24 by Justice N. Sathish Kumar, who noted the existence of a shared wall between the two properties. Both buildings had been constructed by their previous owners, with Ms. Krishnan acquiring her residence in 2005 and her neighbours purchasing theirs only in 2023. The neighbours’ subsequent decision to demolish their house for redevelopment raised alarms due to the potential damage to the common wall, which served as a critical support structure for Ms. Krishnan’s property.

Justice Kumar was particularly concerned about the consequences of damaging or demolishing the common wall, which housed essential infrastructure such as the pipes leading to the overhead tank and drainage system. Citing the potential for serious repercussions, including structural collapse, he expressed the necessity of taking adequate precautionary measures to mitigate any risks. As a result, he granted an interim injunction to prevent further demolition or construction activities. His ruling emphasized that Ms. Krishnan had established a prima facie case for receiving the interim injunction and highlighted the balance of convenience being in her favor, given the likelihood of peripheral injury if her request were denied.

The interim injunction was extended on multiple occasions as ongoing efforts were made for an amicable resolution. These efforts culminated in a significant breakthrough on March 21, 2024, when Ms. Krishnan’s mother and her neighbour attended a High Court session, leading to a mutual agreement to settle the dispute out of court. This settlement was subsequently formalized in the joint compromise memo.

Justice RMT Teekaa Raman, upon reviewing the signed memo, ordered the High Court Registry to proceed with the refund of the court fees in accordance with established rules. This ruling brought closure to a dispute that had momentarily strained relations between Ms. Krishnan and her neighbours but was ultimately resolved through constructive dialogue and compromise.

The amicable settlement highlights a positive outcome for both parties, showcasing the benefits of mediation and mutual understanding in resolving disputes. It also underscores the importance of careful legal considerations in property development, especially when shared structures and essential infrastructure are involved.
