CBFC Imposes Conditions on Kangana Ranaut’s ‘Emergency’ for Certification

In a major development on Thursday, the Central Board of Film Certification (CBFC) informed the Bombay High Court that the certification of actor-politician Kangana Ranaut’s much-anticipated movie, “Emergency,” is contingent upon the filmmakers adhering to specific edits as recommended by the Revising Committee.

The Division Bench presiding over the case, consisting of Justices B.P Colabawalla and Firdosh Pooniwalla, probed the CBFC’s representative—advocate Abhinav Chandrachud—with a pointed query: “Please give us some good news.” Responding to the Bench, Mr. Chandrachud clarified, “CBFC’s revising committee has suggested certain cuts in the film. If the same are made, the film can be released.”

Advocate Abhinav Chandrachud’s remarks were met with legal maneuvering from senior counsel Sharan Jagtiani, who represented Zee Entertainment Enterprises, the distributor for “Emergency.” Mr. Jagtiani urged the Bench to adjourn the hearing, requesting more time to deliberate on whether the filmmakers should incorporate the cuts proposed by the CBFC’s revising committee. Succumbing to this appeal, the Bench adjourned the matter, scheduling it for further hearing on September 30, 2024, Monday.

Kangana Ranaut, who not only stars in the film but also directed and co-produced it, has been ardently pushing for the release of the censor certificate. Documents submitted in the High Court revealed the filmmakers’ frustration, alleging that the CBFC had purposefully delayed providing the physical copy of the certificate despite the certificate’s approval being communicated as early as August 29, 2024. Initially, “Emergency” was primed for a theatrical release on September 6, 2024.

The recent court hearings have put a spotlight on the multifaceted complications surrounding the film’s release. During the last hearing on September 19, the production team revealed to the Bench that Kangana Ranaut, who has also been serving as a Member of Parliament (MP) for Mandi since June 2024, is reportedly facing significant pressure from the Bharatiya Janata Party (BJP).

. The filmmakers alleged that the BJP is attempting to delay the release until post the Haryana elections in October.

This assertion has invited a storm of criticism and drawn considerable scrutiny toward the CBFC’s actions. The Division Bench did not hide its displeasure, criticizing the CBFC for unwarranted delays in the issuance of the certification required for the film’s release.

The film “Emergency” delves into a highly contentious period in Indian history, portraying the events and implications of the national emergency declared in 1975. With its political undertones, the film has attracted not just cinematic but also political interest. Observers argue that its timing—coinciding with the Haryana elections—may have added layers of complexity to an already labyrinthine certification process.

Given Kangana Ranaut’s dual role as an MP and film director, the ongoing impasse over the film’s release adds yet another dimension to the broader discourse on freedom of expression and political interference in the arts. It notably raises questions about the autonomy of India’s certification bodies and their susceptibility to political pressures.

Ranaut has been vocal about her disappointments and has taken to various platforms to air her grievances. With her followers and supporters rallying behind her, the public discussion surrounding the film has only intensified. While she continues her endeavors in the political arena, her journey through the labyrinth of film certification seems equally challenging.

As it stands, the High Court’s adjournment to September 30, 2024, will be a critical juncture. Attendees and stakeholders are keenly awaiting whether the filmmakers will agree to the CBFC’s suggested cuts or if the stalemate will persist, further delaying the film’s much-anticipated release.

For now, industry insiders, political commentators, and Ranaut’s supporters alike are holding their breath, eager to see how this convoluted case will unfold. The stakes are high, and the implications—both for India’s film industry and its political landscape—are profound.
