Controversy Surrounds Kangana Ranaut’s “Emergency” as Madhya Pradesh High Court Weighs In


On Tuesday, September 3, 2024, the Madhya Pradesh High Court took a significant step by disposing of a petition that sought to halt the release of the highly anticipated film “Emergency,” starring Bharatiya Janata Party (BJP) Member of Parliament Kangana Ranaut. The court decision was influenced by the Central Board of Film Certification (CBFC)’s submission that the film’s clearance is currently on hold.

Presided over by acting Chief Justice Sanjeev Sachdeva and Justice Vinay Saraf, the Division Bench has directed the CBFC to take into account the concerns raised in the petition, which primarily objected to various elements depicted in the movie’s trailer. This ruling came on the heels of another critical development the previous day, Monday, September 2, 2024, when the High Court issued notices to Kangana Ranaut, her production company Manikarnika Films, the CBFC, both Central and Madhya Pradesh governments, Zee Studios, and other associated entities.

The petition originated from two Sikh organizations, Jabalpur Sikh Sangat and Guru Singh Sabha, Indore, who raised strong objections against the film’s trailer. They criticized the movie’s portrayal of Sikh individuals and certain dialogue, arguing that it infringes on the fundamental rights of the Sikh community. The petitioners demanded an unconditional apology from Ms. Ranaut and her team.

Key objections articulated in the petition centered around the use of the term “khalistan,” suggesting that its depiction could result in young Sikh children, particularly those wearing patka (a type of turban), being teased as “khalistanis.” The CBFC informed the court that while an initial certificate had been issued for the film, it was subsequently placed on hold following objections from the Sikh community.

In light of the CBFC’s pending certification, the High Court chose not to pass a definitive order at this stage, emphasizing there is no merit in “prejudging” the issue. The bench has taken the viewpoint that any forthcoming representation on the matter should be considered by the CBFC as it continues to review the film in accordance with the Cinematograph Act and the related Cinematograph (Certification) Rules.

The learned Deputy Solicitor General affirmed in court that the film’s certification is under scrutiny and assured that any further objections from organizations, bodies, or individuals would be taken into account during the certification process. This statement resonated with the court’s stance, reinforcing that judicial intervention isn’t warranted at this juncture.

Furthermore, the Sikh petitioners highlighted that they had already communicated their grievances to the CBFC chairman, reinforcing their plea against the movie’s release. In conclusion, the court disposed of the petition, enabling the petitioners to submit a comprehensive representation to the Central Board of Film Certification. As instructed, this submission must be made within three days. Upon receiving the representation, the Board is mandated to consider the objections thoroughly and take swift, appropriate measures regarding the trailer and film certification. These actions must align with the Cinematograph Act and its rules before the final certification is granted.

“Emergency,” a biopic written by Ms. Ranaut, chronicles the life and political turmoil surrounding former Prime Minister Indira Gandhi. Initially slated for a November 2023 release, the film’s launch date has experienced multiple delays. The latest announced release date is September 6, 2024. However, with the CBFC certification still pending, uncertainty looms over whether the film will indeed hit theaters this coming Friday.
