Madras High Court Greenlights Global Release of Thangalaan


The Madras High Court has paved the way for the highly anticipated global release of the film “Thangalaan,” starring ‘Chiyaan’ Vikram. This clearance came on Wednesday, August 14, 2024, following compliance by the film’s producer, K.E. Gnanavelraja, with a court order issued on Monday. The producer had been directed to transfer ₹1 crore to the account of the Official Assignee of the High Court to settle outstanding financial obligations.

A Division Bench comprising Justices G. Jayachandran and C.V. Karthikeyan received and recorded a confirmation from the producer’s counsel, Niranjan Rajagopal. The counsel affirmed that the mandated ₹1 crore had indeed been deposited with the Official Assignee. Consequently, the court observed that there would be no obstacles in releasing the movie worldwide on Thursday, August 15, 2024.

The financial complications leading to this moment stemmed from an agreement dating back to 2011. Under this agreement, producer K.E. Gnanavelraja partnered with businessman Arjunlal Sunderdas for the co-production of a film, each committing to invest ₹40 crore. However, by mid-way, Sunderdas had contributed ₹12.85 crore but opted to withdraw due to financial constraints.

This scenario took a legally complicated turn in 2014 when the High Court declared Sunderdas insolvent. The court then instructed the Official Assignee to evaluate all his assets and liabilities. This move aimed to facilitate the repayment of dues to numerous individuals who had invested in Sunderdas’ real estate and finance ventures.

In the course of this assessment, the Official Assignee identified that Gnanavelraja owed ₹10.35 crore to the insolvent Sunderdas. Consequently, the Official Assignee filed a petition with the High Court in 2016, seeking a directive for Gnanavelraja to repay the amount with an added 18% interest from 2013.

In 2019, the Division Bench granted the petition, mandating that Gnanavelraja repay the owed amount along with the specified interest. However, non-compliance with this court order spurred the Official Assignee to intermittently seek court intervention before the release of each film produced by Gnanavelraja.

To ensure compliance, the High Court ordered the producer to deposit amounts ranging from ₹50 lakh to ₹1 crore, contingent upon each film’s release. This stipulation persisted, compelling the Official Assignee to file an execution petition in 2024 to attach Gnanavelraja’s latest productions, “Thangalaan” and the Suriya-starrer “Kanguva,” which is slated for an October release.

Upon this petition, the Division Bench ordered on Monday that both films could only be released after a deposit of ₹1 crore each by the producer. On Wednesday, Gnanavelraja submitted proof of compliance regarding Thangalaan, thereby securing the court’s approval for its global release.

In light of these events, the decision marks a significant relief for both the film industry stakeholders and fans eagerly awaiting the release of Thangalaan. The convoluted legal history highlights underlying financial complexities and the importance of judicial interventions in the entertainment sector.
