Amidst escalating tensions between gaming operators and regulatory bodies, Gammix Limited has been embroiled in a controversial tussle with the Dutch gaming authority, Kansspelautoriteit (KSA). The saga intensifies as the KSA mandates Gammix to pay a monumental €19.6 million fine for its alleged failure to comply with Dutch gambling regulations.
In an ongoing narrative that began in June 2022, Gammix was given an ultimatum to exit the Dutch market, or face crippling weekly fines that could accumulate to €1.4 million. Despite these stark warnings, by March the following year, the KSA ordered Gammix to pay €4.4 million for continuing its operations within the Netherlands and not adhering to the authority’s directives.
The root of this punitive action stems from Gammix’s perceived negligence in preventing Dutch players from accessing its online gambling platforms. The KSA’s investigation singled out rantcasino.com and nordslot.com as the primary offenders but noted that other sites, including betoriginal.com, had also been available to Dutch audiences. The authority’s scrutiny spanned across 2022, comprising initial probes followed by subsequent inspections, all concluding that Gammix’s sites were readily accessible within Dutch borders.
According to the KSA, the response from Gammix to the investigative reports was dismissive. In May 2023, Gammix contested the findings, arguing that there was no substantive basis for sanctioning. The KSA, however, maintained its stance, citing that these websites could be accessed from a Dutch ISP and were accepting registrations from the Netherlands, as evinced by the presence of the +31 Dutch area code and the absence of the Netherlands in the list of prohibited countries on the sites.
Defying the regulator’s report as “careless” and hastily assembled without due diligence, Gammix faced the heavy-handed fine, reinforcing the KSA’s viewpoint that gaming operators ought to be conversant with and compliant to the national laws pertaining to online gambling, as well as the probable enforcement actions by regulatory bodies.
Not only did the KSA impose the fine, but it further cited multiple aggravating factors that bolstered the fine amount, including charges for inactivity and deficiencies in age verification protocols. Calculations presented by the KSA estimate Gammix’s Dutch turnover to be around €302.7 million, with the €19.6 million fine representing approximately 6.5% of this figure.
Reacting to the fine’s disclosure, Gammix resolved to contest the decision, with director Phil Pearson labeling the fine as “outrageous and unsubstantiated.” Pearson decried the action as an instance of overreach and declared that the company would vigorously defend its position. He revealed that Gammix had implemented blocking measures which, according to Pearson, were seemingly disregarded by the KSA. Pearson further stated that the KSA had been unresponsive to requests for additional information which Gammix sought to ensure regulatory compliance.
Earlier in the day, Gammix shared that during the KSA’s investigation, accounts used to access its sites were created in Luxembourg and were funded via credit card transactions, which contravenes the platforms’ terms and services that prohibit supplying false information during the registration process.
Amid the controversy, Gammix criticized the KSA’s method of calculating the fine, suggesting inaccuracy in figures derived from a web-traffic analysis service and disputing the imposed €240 per click multiplier.
The KSA’s investigative methods, often referred to as the “mystery shopper” technique, have previously sparked disputes. A similar scenario occurred with gaming operator Videoslots, which faced a €9.87 million penalty in March 2023—a decision Videoslots vowed to challenge, accusing the KSA of misusing its investigatory prerogative.
